HIPAA Notice

THIS NOTICE DESCRIBES HOW MEDICAL AND MENTAL HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED, AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
1. Our Legal Duty
Attune Holistic Psychology, PC is required by law to maintain the privacy of your protected health information (PHI), to provide you with this Notice of Privacy Practices, and to abide by the terms of this notice. We are committed to protecting the confidentiality of your mental health information.
2. What Is Protected Health Information (PHI)?
PHI includes any information that identifies you and relates to your physical or mental health, the care you receive, or payment for that care. This includes session notes, diagnoses, treatment plans, billing records, and any other information created or received in the course of your care.
3. How We May Use and Disclose Your Information
We will use and disclose your PHI only in the following circumstances:
a. Treatment
We may use your information to provide and coordinate your mental health care, consult with other treating professionals (with your consent), and maintain clinical records.
b. Payment
We may use your information to process payments, generate superbills, or respond to inquiries from your insurance company if you choose to seek reimbursement.
c. Healthcare Operations
We may use your information for internal practice management, quality improvement, and training purposes, in compliance with HIPAA regulations.
d. As Required by Law
We may disclose your information when required to do so by federal, California, Colorado, or Rhode Island state law.
e. Mandatory Reporting
As a licensed psychologist, we are required by law to disclose information without your consent in the following circumstances:
Imminent danger to self or others — If you present a serious and imminent threat to yourself or another identifiable person, we may be required to take protective action, which may include contacting emergency services or a potential victim.
Child, elder, or dependent adult abuse — We are mandated reporters and are required by law to report known or reasonably suspected abuse.
Court order — We may be compelled to disclose records by a valid court order or subpoena.
f. With Your Written Authorization
All other disclosures — including to family members, other healthcare providers not involved in your treatment, or any third parties — require your prior written authorization. You may revoke that authorization at any time in writing.
4. Your Rights Regarding Your Health Information
You have the right to:
Access your records — Request a copy of your PHI. We may charge a reasonable fee for copying.
Request amendments — Ask us to correct information you believe is inaccurate or incomplete.
Request restrictions — Ask us to limit how we use or share your information (we are not always required to agree).
Request confidential communications — Ask us to contact you in a specific way or at a specific location.
Receive an accounting of disclosures — Request a list of disclosures we have made of your PHI other than for treatment, payment, or operations.
Receive a copy of this notice — You may request a paper copy of this notice at any time.

5. Telehealth & Electronic Communications
Telehealth sessions are conducted through the SimplePractice Client Portal, a HIPAA-compliant, encrypted platform. However, please be aware:
Email and standard text messaging are not HIPAA-compliant. Please do not send clinical information through these channels.
All clinical communication should occur through the SimplePractice Client Portal.
Electronic records are stored using HIPAA-compliant systems with appropriate safeguards.
6. Confidentiality of Substance Use Records
If applicable, records related to substance use treatment are subject to additional federal confidentiality protections under 42 CFR Part 2 and may not be disclosed without your specific written consent except in limited circumstances.
7. Complaints
If you believe your privacy rights have been violated, you may file a complaint with:

8. Changes to This Notice
We reserve the right to change this notice at any time. The revised notice will be posted on our website and will apply to all PHI we maintain. You may request a current copy at any time.
